Sanita Osipova participates in the high-level discussion on equal access to justice: respecting the court means respecting a state governed by the rule of law

On Friday, 6 July, the Vice-president of the Constitutional Court Sanita Osipova participated in the high-level discussion on equal access to justice organised by the Organisation of Economic Cooperation and Development (hereinafter – OECD), the Court Administration and the Ministry of Justice. The discussion was opened by the Secretary General of OECD Angel Gurria and the Minister for Justice Dzintars Rasnačs.

Sanita Osipova in her address underscored that the right to a fair trial and the right to access to the court were fundamental rights, that these were the most important rights of a person, as the existence of these gave the possibility to enjoy in full other rights granted to a person.

She noted that in developing access to court not only the legal regulation but also the work of judges was important. Sanita Osipova emphasised that a court was not service provision but was restoration of justice. Therefore the court should maintain an individual approach to each case since the aim of legal proceedings is a fair resolution.

Sanita Osipova underscored: “Respecting the court means respecting a state governed by the rule of law. This should be understood both by society and by the two other state powers. The independence of a court is not arbitrariness of a court but rather an instrument in the hands of  a court to guarantee justice in society.

Upon concluding the address, Sanita Osipova presented to the Secretary General Angel Gurria a collection of the most important rulings by the Constitutional Court, which included the most significant rulings that had been passed and promulgated by the Constitutional Court in the two decades of its existence.

The high-level discussion was the concluding discussion in the framework of the two-day international discussion “Equal Access to Justice”, which was held on 5 and 6 July in The House of Blackheads, Riga.
