A case on dismissal of the Local Government Council of Rēzekne State City has been initiated

A case was initiated in the Constitutional Court on compliance of Section 1 and Section 4 of the Law on Dismissal of the Local Government Council of Rēzekne State City and Section 1(3)(2) of the Law on the Election of Local Government Councils with the Article 1 and Article 101 of the Constitution of the Republic of Latvia.

The applicant is the Local Government Council of Rēzekne State City. The Council was dismissed by Section 1 of the Law on Dismissal of the Local Government Council of Rēzekne State City. Whereas Section 4 of the Law on Dismissal of the local Government Council of Rēzekne State City and Section 1(3)(2) of the Law on the Election of Local Government Councils provide that temporary administration shall act in the local government of Rēzekne State City until the regular Council election.

The applicant states that the operation of the Council has been terminated by the contested provisions and a temporary administration has been appointed to act until the regular Council elections in June 7 of 2025. During this time, a democratically legitimised council as the local government institution elected by the local residents shall not operate in the local government of Rēzekne state city. The applicant views the contested provisions as disproportionate and in violation of the local government principle because it prevents it from the right to govern its administrative territory in the interest of the population.

The Constitutional Court invited the institution that has issued the contested law – the Saeima – to submit to the Constitutional Court a reply with the explanation of the actual circumstances of the case and the legal basis by 23 September 2024. The deadline for the preparation of the case is 22 December 2024. The Court will decide on the procedure and date for hearing the case once the case is prepared.
