A case on disclosure of shareholders of a joint-stock company has been initiated before the Constitutional Court

A case has been initiated before the Constitutional Court on a constitutional complaint “On Conformity of Section 4.15, Clause 2, Sub-clause “b” of the Law On the Register of Enterprises of the Republic of Latvia with Article 96 of the Constitution of the Republic of Latvia”.

The contested norm provides that the public part of the registration file shall include information from the section of the register of shareholders on the shareholders of the joint-stock company.

The applicants consider that the contested norm disproportionately restricts their right to inviolability of private life guaranteed by Article 96 of the Constitution.

The Constitutional Court invited the institution that has issued the contested law – the Saeima – to submit to the Constitutional Court a reply with the explanation of the actual circumstances of the case and the legal basis by 26 March 2024.

The term for preparing the case is 26 June 2024. The Court will decide on the procedure and date for hearing the case once the case is prepared.
