The Constitutional court of Latvia starts a project for exchange of experience with the Constitutional court of Moldova

The Constitutional court of Latvia starts a project for exchange of experience “Strengthening the Capacity of the Legal Service of the Constitutional court of Moldova”. During this project, the personnel of the Constitutional court and experts will provide several webinars with the aim to strengthen the capacity of the Constitutional court of Moldova.

The aim of the project is to enhance the professional knowledge of judges and lawyers of the Constitutional court of Moldova and to strengthen the court’s capacity to conduct constitutional expertise consistently, including through the application of international human rights law and case law in assessing the legality of restrictions to human rights. The exchange project consists of two phases and it will finish at the end of November. The first phase of the project is intended for the lawyers of the Constitutional court of Moldova, while the second phase is organised for the Judges of this Court. The webinars will consist of study lectures and round table discussions on the issues of the organization of the work of both constitutional courts and the use of the methodology for the evaluation of human rights restrictions. The project leader is Elīna Podzorova, Adviser to the Constitutional court of Latvia.

On the first day of the exchange project, October 12, a webinar was held on the role of the Constitutional court in the constitutional system of the Republic of Latvia and the main issues of the work organization and case law of the Constitutional court of Latvia were addressed. The subject of the second day of the project is the scope of competences of the Constitutional court and organization of its panels, deciding on the admissibility of the cases. The criteria for the admissibility of applications will also be discussed. Lectures for the first stage of the project are prepared by Kristaps Tamužs, Head of the Legal Department of the Constitutional court, and constitutional law expert Alla Spale.

In the next stage of the project, several webinars will be held on the Constitutional court proceedings, preparation of decisions, use of methods of interpretation of legal norms and application of European and international legal norms.

The Constitutional courts of Latvia and Moldova have a long history of joint co-operation with. Already in 2019, the Constitutional court, together with the Ministry of Foreign Affairs of Latvia, conduct a project aimed at strengthening the capacity of the Constitutional court of Moldova. During this first project, a training for the personnel of the Constitutional court of Moldova, was provided. Also, four Judges of the Constitutional court of Moldova took participation in the first project of co-operation.

The project for exchange of experience is implemented with the financial aid of the Ministry of Foreign Affairs of Latvia provided under funds of the budget programme 07.00.00 “development projects for cooperation and international aid”.
