Justice of the Constitutional Court Artūrs Kučs participates in high-level conference in Paris

From 12 to 13 September, Justice of the Constitutional Court Artūrs Kučs will attend a high-level conference organised by the Court of Cassation (Cour de cassation) and the Constitutional Council (Conseil constitutionnel) of France, to which Presidents and representatives of all European constitutional and supreme courts have been invited. The conference aims to promote judicial dialogue and discussions on recent developments of global scale in constitutional law.

Organisers of the conference draw attention to the fact that guaranteeing human liberty and reinforcement of the rule of law is one of the basic pillars of the European values. To ensure stability, the European Court of Human Rights (hereafter – ECtHR) and the Court of Justice of the European Union, national constitutional and supreme courts compare and approximate opinions in an ever-closer dialogue, jointly shaping the united European legal space.

In view of the significant interaction between the European and national courts, three working sessions have been scheduled for the conference. The first will be dedicated to discussion about ensuring effective legal protection and the role of an independent, unbiased judge in legal proceedings. The session will be moderated by the Constitutional Council of France.

During the second session, judges will discuss the dialogue between national courts and ECtHR, application of the European Convention on Human Rights and the use of EChRT’s judicature in court’s rulings. This discussion will be organised by the Council of the State of France (Conseil d’État).

During the third session, in turn, the participants of the conference will discuss the growing scope of online communication and increasing use of social networks, which causes a challenge to find a balance between a person’s right to freedom of speech versus a person’s right to inviolability of private and family life. This session will be led by the Court of Cassation of France.

Participants of the Conference, among them also Justice of the Constitutional Court Artūrs Kučs, have been invited to an official reception at the Élysée Palace by President of France Emmanuel Macron.

The conference is held in the framework of France’s Presidency in the Council of Europe. Representatives of the judicial power from 47 countries will attend the conference.
