A case on conditions for granting scholarships has been initiated

The First Panel of the Constitutional Court has initiated a case “On Compliance of Section 1.1 of 2 June 2009 Cabinet of Ministers Regulation No. 511 “Amendments to 24 August 2004 Cabinet of Ministers Regulation No. 740 “Regulations regarding Scholarships”” with Article 91 and 112 of the Satversme of the Republic of Latvia”.

Article 91 of the Satversme guarantees, among the rest, equality of persons before the law and the courts, whilst Article 112 of the Satversme establishes the right to education.

The Contested Norm regulates conditions for granting scholarships by providing that priority, when granting scholarships, shall be given to less protected individuals, like, disabled persons, orphans, low-income persons, students with children and others.

The applicants Edgars Ābols and Artūrs Pušmucāns hold that the aim of scholarships is motivation and supporting of gifted students rather than social assistance.

The Cabinet of Ministers has been asked to provide, before 30 September 2010, a reply on facts of the case and legal justification thereof. The term of preparation of the case is 30 December 2010.
